Jet's Pizza operates as a food service business offering customers the ability to browse our menu, place online food orders for delivery or pickup, participate in loyalty programs and promotional offers, and communicate with our customer service team through the Site located at pizzajets-meal.rest.

Our Services include, but are not limited to:

All prices displayed on our Site are in United States Dollars (USD) and are subject to applicable sales taxes and fees as required by federal, state, and local law. We reserve the right to change prices at any time without prior notice. Prices are subject to change, and the price you pay will be the price displayed at the time your order is confirmed.

5.3 Payment

The Jet's Pizza name, logo, and all related product and service names, design marks, and slogans are trademarks or service marks of Jet's Pizza. All other trademarks, service marks, and trade names displayed on the Site are the property of their respective owners.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and its Content solely for your personal, non-commercial use in connection with our Services. This license does not include the right to:

If you submit, post, or otherwise provide any reviews, comments, photos, or other content to our Site or through our Services ("User Content"), you grant Jet's Pizza a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that your User Content does not infringe upon the rights of any third party, is not defamatory or unlawful, and that you own or have the necessary rights and permissions to submit such content. We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR INFORMATION AVAILABLE THROUGH THE SITE;
• WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED;
• WARRANTIES THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not warrant or represent that any food items ordered through our Site will meet your individual dietary requirements, nutritional expectations, or personal taste preferences. You are responsible for reviewing menu descriptions and allergen information before placing an order. While we endeavor to provide accurate allergen and nutritional information, we cannot guarantee that our food preparation environments are free from cross-contamination.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JET'S PIZZA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, REVENUE, SAVINGS, OR BUSINESS OPPORTUNITIES;
• LOSS OF DATA OR GOODWILL;
• COST OF SUBSTITUTE GOODS OR SERVICES;
• PERSONAL INJURY OR PROPERTY DAMAGE;
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES;
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY.

IN NO EVENT SHALL JET'S PIZZA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT JET'S PIZZA HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE.

Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you to the extent prohibited by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its affiliates, officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys' fees) arising out of or related to:

• Your use of, or inability to use, the Site or Services;
• Your violation of these Terms;
• Your violation of any third-party rights, including without limitation any intellectual property rights, privacy rights, or proprietary rights;
• Your violation of any applicable federal, state, or local law or regulation;
• Any User Content you submit, post, transmit, or otherwise make available through the Services;
• Any dispute or issue between you and any third party;
• Your fraud, willful misconduct, or gross negligence.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you agree to cooperate with our defense of such claims. You agree not to settle any such matter without our prior written consent. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

12. Third-Party Links and Services

Our Site may contain links to third-party websites, services, or applications that are not owned or controlled by Jet's Pizza. We have no control over and assume no responsibility for the content, privacy policies, terms of service, or practices of any third-party websites or services. We do not warrant the offerings of any of these third parties or their websites.

You acknowledge and agree that Jet's Pizza shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any content, goods, or services available on or through any such third-party websites or services.

We strongly encourage you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

13. Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or related to them or your use of the Services shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which our principal place of business is located, without giving effect to any principles of conflicts of law.

To the extent that any dispute is not subject to arbitration as provided below, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the applicable jurisdiction of our principal place of business for the resolution of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services.

Our Services are intended for use within the United States. We make no representation that the Services are appropriate or available for use outside of the United States. If you access the Services from locations outside the United States, you do so at your own risk and are responsible for compliance with applicable local laws.

14. Dispute Resolution and Arbitration

14.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact Jet's Pizza at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within that time, either party may proceed to formal dispute resolution as described below.

14.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for disputes that qualify for small claims court, all disputes, claims, or controversies arising out of or relating to these Terms, your use of the Services, or your relationship with Jet's Pizza that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

The arbitration shall be conducted on an individual basis. You and Jet's Pizza each waive any right to a jury trial and waive any right to participate in a class action lawsuit or class-wide arbitration.

14.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, MASS ACTION, OR REPRESENTATIVE PROCEEDING.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.

15. Food Safety and Allergen Information

We take food safety seriously and strive to comply with all applicable federal and state food safety regulations, including standards established by the U.S. Food and Drug Administration (FDA) and applicable state health departments. However, you acknowledge and agree that:

• Our food products are prepared in facilities that may handle common allergens, including but not limited to gluten, dairy, eggs, nuts, soy, fish, and shellfish;
• We cannot guarantee that any menu item is entirely free from allergens or cross-contamination;
• It is your responsibility to review allergen information available on our Site or by contacting us prior to placing an order if you have known food allergies or dietary restrictions;
• Individuals with severe food allergies should exercise particular caution and consider whether it is appropriate to order from us.

16. Term and Termination

Upon termination, the following sections shall survive and remain in full force and effect: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, Dispute Resolution, and all other provisions that by their nature should survive termination.

17. Changes to Terms of Service

We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will provide notice by:

The remaining provisions of these Terms shall be construed as if the invalid, illegal, or unenforceable provision had never been included herein.

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Jet's Pizza with respect to your use of the Site and Services. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, between you and Jet's Pizza regarding the subject matter hereof.

No waiver by Jet's Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Jet's Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Force Majeure

Jet's Pizza shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions or restrictions, labor disputes, internet service disruptions, power outages, or any other cause beyond our reasonable control ("Force Majeure Event"). In the event of a Force Majeure Event, we will make reasonable efforts to notify you and to resume performance of our obligations as soon as practicable.

21. Electronic Communications and Consent

By using our Services or communicating with us electronically, you consent to receive communications from us electronically. We may communicate with you by email or by posting notices on our Site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by applicable law.

If you have signed up for promotional communications, you may opt out at any time by following the unsubscribe instructions contained in those communications or by contacting us directly. Please note that even after you opt out of promotional communications, you may continue to receive transactional and account-related emails from us.

22. No Agency or Partnership

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, franchise, or agency relationship between you and Jet's Pizza. You do not have authority to make any representations or commitments on our behalf, and you shall not attempt to create any obligation or liability, express or implied, on our behalf.

23. Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, to any third party without our prior written consent. Jet's Pizza may freely assign or transfer these Terms, or any of its rights or obligations hereunder, without restriction and without notice to you. Subject to the foregoing, these Terms will be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.

Nothing in these Terms is intended to limit or waive any rights you may have under applicable consumer protection laws. As a consumer, you may have additional rights under the laws of your state. For example, consumers in California may have additional rights under the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and other California consumer protection statutes. Federal consumer protection rights under the Federal Trade Commission Act (FTC Act) also apply. To the extent that any provision of these Terms conflicts with applicable consumer protection law, such applicable law shall control.
